Cross-Defendants’ Demurrer is DENIED as moot.

BACKGROUND:

On September 26, 2022, Plaintiff In Hospitality LLC filed its Complaint against Defendants Launch with Us, LLC, Mike Lee, and Jody Hashimoto on various causes of action arising from Plaintiff’s contractual relationship(s) with Defendants.

On December 5, 2022, Defendant filed their Answer to the Complaint.

Also on December 5, 2022, Defendant/Cross-Complainant Launch with Us, LLC filed its Cross-Complaint against Cross-Defendants In Hospitality, LLC, Dong Hyuk Lee, Jeff Jun, and Kevin Minsoo Son.

On February 3, 2023, Plaintiff/Cross-Defendant In Hospitality LLC (“Plaintiff/Cross-Defendant”) filed its Answer to the Cross-Complaint.

On February 24, 2023, Cross-Defendants Jeff Jun, Kevin Minsoo Son, and Dong Hyuk Lee (“Cross-Defendants”) filed their Demurrer to the Cross-Complaint. Cross-Defendants concurrently filed: (1) Declaration of Steven Han; and (2) Proposed Order.

On April 7, 2023, Defendant/Cross-Complainant filed its First Amended Cross-Complaint. 

ANALYSIS:

On February 24, 2023, Cross-Defendants filed their Demurrer to the Defendant/Cross-Complainant’s Cross-Complaint. On April 7, 2023, Defendant/Cross-Complainant filed its First Amended Cross-Complaint. Thus, Cross-Defendants’ Demurrer is moot.

The Court DENIES as moot Cross-Defendants’ Demurrer.
