On September 5, 2023, the Court was advised by the parties that they had resolved this case, and set an OSC re Approval of PAGA Settlement for October 20, 2023.

Plaintiff did not appear at the hearing, and no documents regarding the approval of the PAGA settlement were filed with this Court.

        On that date, the Court continued the OSC re Approval of the PAGA Settlement until November 27, 2023. The Court stated in open court that if the Settlement was not approved by that date, the Court would consider dismissing the case.  The Court further ordered the parties to file their proposed PAGA settlement at least two weeks prior to the next hearing. 

        The Court continued the hearing to today’s date.

        As of the posting of this tentative decision on December 16, 2023, the Court has not received any documents regarding the approval of a PAGA settlement.

        The Case is DISMISSED.
