PLAINTIFF'S REQUEST FOR ENTRY OF DEFAULT JUDGMENT

 

 

I.           BACKGROUND

 

On January 10, 2023, Plaintiff Interpool, Inc. filed its Complaint against Defendants Safe Cal Transport, Inc., Cecilia Martinez, and Alexander Palacios.

 

On May 8, 2023, by request of Plaintiff, the Clerk’s Office entered default on all three Defendants.

 

On May 30, 2023, Plaintiff:

 

(1)       CIV-100, Request for Entry of Default;

(2)       CIV-110, Request for Dismissal;

(3)       JUD-100, Proposed Judgment;

(4)       Declaration in Support of Default Judgment;

(5)       Declaration in Support of Attorney’s Fees as Costs; and

(6)       Declaration re Interest.

 

On June 5, 2023, by request of Plaintiff, the Clerk’s Office dismissed without prejudice Defendants Cecilia Martinez, Alexander Palacios, and Does 1 through 20 from the Complaint.

 

II.        ANALYSIS

 

The Request for Default Judgment is GRANTED, conditional on Plaintiff filing the Declaration of Nonmilitary Status (Item 8 on the CIV-100) with the Court regarding the remaining Defendant, Safe Cal Transport, Inc.

 

        Judgment is awarded in favor of Plaintiff Interpool, Inc. and against Defendant Safe Cal Transport, Inc. in the total amount of $47,650.14, as indicated below.
