PLAINTIFF'S REQUEST FOR ENTRY OF DEFAULT JUDGMENT

I.          BACKGROUND

On June 7, 2023, Plaintiff Gustavo Navarro Perez filed his Complaint against Defendants Tacos La Guera Al Vapor, Inc. and Rocio Hernandez.

On September 27, 2023, by request of Plaintiff, the Clerk’s Office entered default against Defendants.

On November 17, 2023, Plaintiff filed:

(1)       Judicial Council Form CIV-100, Request for Court Judgment;

(2)       Judicial Council Form CIV-110, Request for Dismissal;

(3)       Judicial Council Form JUD-100, Proposed Judgment;

(4)       Declaration of Gustavo Navarro Perez;

(5)       Declaration of Tara Hattendorf; and

(6)       Summary of Case.

On November 20, 2023, by request of Plaintiff, the Clerk’s Office dismissed the Doe defendants.

II.       ANALYSIS

The Request for Default Judgment is GRANTED in part. Default Judgment is AWARDED in favor of Plaintiff and against Defendants, jointly and severally, in the total amount of $40,186.70. This accounts for $33,882.71 in damages, $3,996.30 in pre-judgment interest, $1,526.37 in attorney’s fees, and $781.32 in costs as indicated in the spreadsheet below.  The maximum allowable attorney's fees in this default case is $1,526.37. (See LASC Local Rule 3.214.)
