PLAINTIFF'S REQUEST FOR ENTRY OF DEFAULT JUDGMENT

 

 

 

I.          BACKGROUND

 

On December 28, 2023, Plaintiff Buchalter filed its Complaint against Defendant Matthew Nunez on causes of action for breach of contract, account stated, open book account, and reasonable value of services.

 

On March 29, 2024, Plaintiff filed:

 

(1)       Judicial Council Form CIV-100, Request for Entry of Default and Court Judgment;

 

(2)       Judicial Council Form CIV-110, Request for Dismissal; and

 

(3)       Judicial Council Form JUD-100, Proposed Judgment.

 

On March 29, 2024, by request of Plaintiff, the Clerk’s Office entered default on Defendant.

 

        On April 2, 2024, Plaintiff filed Declaration of Michael B. Fisher.

 

On April 3, 2024, by request of Plaintiff, the Clerk’s Office dismissed without prejudice the doe defendants from the Complaint.

 

II.       ANALYSIS

 

The Request for Default Judgment is GRANTED.

 

Default Judgment is AWARDED in favor of Plaintiff and against Defendant in the total amount of $133,578.72 as indicated below:
