The proposed judgment needs to be modified.

·        ¶ 5 of proposed judgment against Andre Tua’au is incorrect.  The amounts should be:

o   Penalty of $1,000/claim                     $16,561,000.00

o   Civil assessment:                               $  8,212,298.57

o   Total                                                 $24,773,298.57

·        ¶ 9 of proposed judgment is too broad

o   “working in any clinic or hospital setting” would prevent Defendants from working as a custodian at a clinic

o   Also, “clinic or hospital setting” is vague.

Court requests Plaintiff to revise these paragraphs of the proposed judgment prior to the 10/27/22 hearing.

It is also not clear to the Court whether the Doe Defendants have been dismissed.
