[TENTATIVE] ORDER DENYING PLAINTIFF’S MOTION TO CORRECT THE RECORD BY GRANTING A DECREE CHANGING NAME, NUNC PRO TUNC.

 

            On August 4, 2022, the Court granted Jeff Medina’s petition to change name to Jeffrey Medina, in order to conform to his personal preference. Petitioner asserts that his birth certificate identifies his legal name as “Jeff Medina Solorzano” not Jeff Medina. Therefore, Petitioner requests an order to change his name from Jeff Medina Solorzano to Jeffrey Medina Solozano, nunc pro tunc.  

            The Court vacates its order of August 4, 2022, since it erroneously identified Petitioner’s legal name as “Jeff Medina” and is based on a Criminal History Assessment that is not Petitioner’s legal name. The Court DENIES Petitioner’s motion because Petitioner must re-start the name change process based on his legal name.

            Therefore, Petitioner is ordered to file an amended petition and proposed Order to Show Cause to change his name from Jeff Medina Solorzano to Jeffrey Medina Solorzano.

Petitioner is required to publish the amended Order to Show Cause showing the correct legal and proposed name for the required time period. Code Civ. Proc., § 1277. Petitioner shall also submit a Criminal History Assessment request based on Petitioner’s legal name.

            The Clerk will set a new date for the Order to Show Cause upon Petitioner’s filing of the amended petition and supporting documents identified above.
