INSTRUCTIONS: If the parties wish to submit on the tentative ruling and avoid a court appearance on the matter, the moving party must:

[TENTATIVE] ORDER CONTINUING THE HEARING ON PETITIONS FOR CHANGE OF NAME

 

 

Rebecca DeJesus Ramirez, on behalf of three minor children, filed petitions for change of name on October 24, 2022.  If only one parent consents to the name changes, Petitioners are required to disclose the other parent’s name and address and serve the other parent with the Order to Show Cause at least 30 days before the hearing. Code Civ. Proc., § 1277(a)(4). The OSC shall be personally served on the other parent if that parent resides in California. Id. Service outside California may be accomplished by mail.  Id. The petitions do not identify the name and address of each parent. Petition, ¶ 7.e, and they are signed by only one parent.

Petitioners are required to make diligent efforts to locate the other parent:

  1. If Petitioners determine the other parent’s location, Petitioners are ordered to serve the OSC on the other parent as described above at least 30 days before the next hearing date and file the proof of service with the court.
  2. If Petitioners are unable to locate and serve the other parent with a copy of the OSC, Petitioners shall file a supplemental declaration stating what attempts were made to locate the other parent and why service cannot be reasonably accomplished. The supplemental declaration shall be filed no less than 10 court days before the continued hearing date.
  3. In either case, Petitioners are also ordered to comply with the requirements for publication of the Orders to Show Cause prior to the next hearing. Code Civ. Proc., § 1277.

Accordingly, the court continues the hearing to February 14, 2023, at 8:30 a.m. in Department A of the Compton Courthouse for Petitioners to comply with the foregoing orders.
