[TENTATIVE] ORDER TAKING OFF CALENDAR PLAINTIFF’S MOTION FOR APPROVAL OF SETTLEMENT

 

       This is a representative action to recover civil penalties pursuant to the Private Attorneys General Act (“PAGA”) for Defendant’s alleged Labor Code violations. Plaintiff filed this motion for the court’s approval of Plaintiff’s settlement.

       PAGA settlements must be reviewed and approved by the superior court. (Lab. Code, § 2699 subd. (s)(2).) The proposed settlement shall also be submitted to the Labor and Workforce Development Agency (LWDA) for enforcement of labor laws. (Id.) Documents to be submitted to the LWDA "shall be transmitted online through the same system established for the filing of notices and requests.” (Lab. Code, § 2699 subd. (s)(4).) Plaintiff discloses the intent to submit the motion to the LWDA as well as Defendant. (White Decl. ¶ 21.) There is no online confirmation of Plaintiff’s submission of the motion to the LWDA, nor is the motion accompanied by a proof of service on interested parties. (Code Civ. Proc., § 1005.)
