[TENTATIVE] ORDER GRANTING PETITION TO CONFIRM ARBITRATION AWARD BY GUESS?, INC.

 

 

       The complaint alleges that Plaintiff, Debra Lynn Griggs, was subjected to discrimination and harassment while employed by Defendant, Guess?, Inc. (“Guess”). On December 30, 2021, the parties stipulated to arbitrate Plaintiff’s claims.

       At arbitration, Defendant, (Petitioner herein), filed a motion for summary disposition which the arbitrator granted on December 11, 2024 in favor of Guess. The arbitrator did not award costs or fees to Guess.

       Guess now moves to confirm the award and enter judgment in Guess’s favor. Guess timely served the petition on Plaintiff, who did not file an opposition.

       Where a petition to confirm the arbitration award is duly served and filed, "the court shall confirm the award as made, whether rendered in this state or another state, unless in accordance with this chapter it corrects the award and confirms it as corrected, vacates the award or dismisses the proceeding.” (Code Civ. Proc., § 1286.)

       If the court confirms the award, "judgment shall be entered in conformity therewith. The judgment so entered has the same force and effect as, and is subject to all the provisions of law relating to, a judgment in a civil action of the same jurisdictional classification; and it may be enforced like any other judgment of the court in which it is entered, in an action of the same jurisdictional classification." (Code Civ. Proc., § 1287.4.)

       The arbitrator issued the final award on December 12, 2024 in favor of Guess. (Pet. Att. 8(c).) The award was served on Plaintiff’s counsel. (Pet. Item No. 9.) As there is no basis for correcting or vacating the award or to dismiss the proceeding, Petitioner/Defendant’s motion is GRANTED.
