The Court is granting Defendant's ex parte application to continue the trial in this case.  The Court finds that the information Defendant submitted in support of the opposition reflects good cause to continue the trial.   The final status conference date of November 27, 2024 and the the trial date of December 16, 2024 are vacated.

Defendant also sought through the ex parte application leave to file a cross-complaint, or alternatively, to shorten time on a motion to file a cross-complaint.  As to that request, the Court is directing Defendant to file a noticed motion for leave to file a cross-complaint.   The hearing on the motion is specially set for December 13, 2024 at 8:30 a.m.  Defendant must file and serve his motion and supporting memorandum by November 22, 2024.  Plaintiff's opposition brief is due December 2, 2024.  Defendant's reply is due December 9, 2024.  The Court is setting a case management conference for December 13, 2024 at which the trial will be reset.
