The Court is denying the motion of Plaintiff Michael Paul Ramsey ("Paul") for an order quashing the deposition notice that Defendant Patrick Allen Ramsey ("Patrick") issued to Camille Ramsey ("Camille"), or alternatively, for a protective order that limits the scope of Patrick's deposition of Camille. The premise of Paul's motion is that Camille only has knowledge of Paul's battery claim against Patrick, not his quantum meruit claim, and therefore Patrick's counsel should not be permitted to question Camille at her deposition about anything other than the alleged battery. Paul's premise is incorrect. The evidence before the Court indicates that Camille has knowledge of both the battery claim and the quantum meruit claim. Accordingly, it is appropriate for Patrick's counsel to question Camille about both claims at her deposition. Camille's deposition shall take place in person, at the office of Patrick's counsel.
The Court takes this opportunity to advise counsel for Paul and Patrick that the case is on calendar on February 10, 2025 also for a further status conference in the lead-up to the trial that is scheduled for late next month. The Court will inquire of counsel at the further status conference as to whether the case is on track to go to trial as scheduled and whether the parties are trying to resolve their dispute short of a trial.
Finally the Court will address on February 10, 2025 the notice of related case that Patrick filed seeking to relate this action with Paul's recently-filed malicious prosecution action.
