The Court is denying the motion of Plaintiff-Cross Defendant Joshua Cohen to consolidate this action, which is Case Number 21STCV38449, with the related case of Michael Cohen v. Ovaspayan, which is Case Number  22STCV21789.  In reaching that conclusion, the Court was persuaded by the arguments in the opposition to the motion that was filed by Defendants-Cross Complainants Edvin Ovasapyan and Shery Zarnegin.

The Court is granting in part the ex parte application of Edvin Ovaspayan to advance and deny or strike the motion to quash the service of the summons and the Second Amended Cross-Complaint that was filed by Cross-Defendant Celimar Guerra Da Silva Cohen, sued as Ceu Guerra aka Sky Guerra aka Ceu Guerra Cohen (“Guerra”).  Guerra also filed a motion to quash the service of the summons and the Second Amended Complaint in Case Number 22STCV21789.  Guerra's motions in the two actions are currently set to be heard on January 29 and January 30, 2025, which are after the scheduled start of the trial in the two actions.  The Court is setting for hearing on November 19, 2024 at 8:30 a.m. Guerra's  motions in both actions.
