The Court is granting Defendants' motions for protective orders as to the requests for admissions in excess of the 35 allowed per Plaintiff that were propounded on them.
There are three Plaintiffs in this action, two of whom are minors, and three Defendants. By Plaintiffs' count, each of them propounded 78 requests for admission on each of the three Defendants. Notwithstanding the declarations that Plaintiffs submitted in support of propounding 43 more requests for admissions than allowed (78 minus 35 = 43), the Court does not see why this particular landlord-tenant/ habitability of leased property case is any more complex than the dozens of such cases that this Court has /has had on its docket. The Court will discuss at the hearing today an appropriate number of requests for admission.
The Court is, however, denying the Defendants' requests in their motions that the Court impose monetary sanctions against the Plaintiffs for propounding the number of requests of admissions that they did.
