Message from Judge Small to all counsel in Martin v. Carter

This case is on calendar in Dept 57 on Tuesday April 1, 2025 at 9:30for (i) an informal discovery conference ("IDC") regarding a dispute between Plaintiffs and the Carter Defendants, and (ii) a case management conference. 

There is a hitch:  I have been summoned for jury duty at the Foltz Courthouse, a few blocks from Mosk,  at 9:45 on April 1, 2025.  I will have to leave Mosk at 9:30 to walk to Foltz.  If possible, I would like to conduct the IDC and the CMC at 8:30.   The calendar is very, very light -- just two OSCs re dismissals.  I am hoping that some of you see this message.  The Clerk in Dept 57 will reach out to all of you first thing in the morning on Tuesday April to try to coordinate an earlier call of the case.  Apologies for the inconvenience. 

As to the IDC, set forth below, is my suggested resolution of the disputes of Plaintiffs' RFP Nos. 16 and 17.  Under the proposed resolution, the two RFPs become four more narrowed RFPs.  

All internal communications related to construction projects YOU were concurrently working on while working on the PROJECT for the PLAINTIFFS from August 1, 2019 through September 30, 2021. 

All communications with subcontractors related to construction projects YOU were concurrently working on while working on the PROJECT for the PLAINTIFFS from August 1, 2019 through September 30. 2021.  

All contracts with the owners of properties on which YOU were concurrently working on construction projects while working on the PROJECT for the PLAINTIFFS from  August 1, 2019 through September 30, 2021.

All contracts with subcontractors related to construction projects on which you were concurrently working while working on the PROJECT for the PLAINTFFS from August 1, 2019 through September 30, 2021.
