The Court's tentative ruling is to grant the Plaintiffs' motion for summary adjudication as to the first cause of action in their complaint, which alleges that the Defendant violated the Investigative Consumer Reporting Agencies Act ("ICRAA"). In the Court's view, there are no disputed issues of material fact as to the Plaintiffs' ICRAA claims.
Defendant's motion for summary judgment is denied. So too is Defendant's motion for summary adjudication as to the ICRAA claims of the three of the Plaintiffs. The undisputed material facts as to the ICRAA claims run one way here at the summary adjudication phase. And that direction is in favor of the Plaintiffs, who, as indicated above, are entitled to summary adjudication on those claims.
At the hearing on the dueling motions, the Court will give counsel for Defendant an opportunity to identify undisputed facts that run in the Defendant's direction.
