Judge: Michael Small, Case: 22STCV37830, Date: 2023-12-07 Tentative Ruling
Inform the clerk if you submit on the tentative ruling. If moving and opposing parties submit, no appearance is necessary.
Case Number: 22STCV37830 Hearing Date: December 7, 2023 Dept: 57
Plaintiff's motion to compel further responses to Special Interrogatories, Set One, Numbers 5, 7, 8, and 9, is granted in part. It is granted to the extent Plaintiff sought the information called for in those interrogatories. It is denied to the extent Plaintiff sought sanctions against Defendant.
At the hearing, the Court will discuss with the parties whether notices to the employees whose names would be disclosed in response to Interrogatory Number 5 should be provided under Belaire-West Landscape v. Superior Court, 149 Cal.App.4th 554 (2007), to protect employee privacy interests. Williams v. Superior Court (2017) 3 Cal.5th 531, does not require Belaire-West notices. But Williams case indicates that trial courts have discretion to require them in appropriate cases.
