The Court is granting the Defendant's motion for judgment on the pleadings with leave to amend.  The Defendant's arguments in support of the motion are persuasive.  Simply put, Plaintiff has failed to state a claim for whistleblower retaliation under Labor Code Section 1102.5 and wrongful termination in violation of public policy.  The Court will elaborate on its views at the hearing.

The Court also is advising the parties that the discovery motion on calendar for October 7 will be heard on October 8, along side two other discovery motions on calendar that day.  And the Court on October 7 will discuss with counsel the consolidation of hearings on three other discovery motions that are set for hearing in October.
