The motion of Defendant Centinela Car Wash, Inc. dba Playa Vista Car Wash for an order quashing Plaintiff California State Labor Commissioner's asserted service of the summons and complaint in this action on the Defendant and setting aside the Clerk's default against Defendant for failing to respond to the complaint is granted.   Through its motion, Defendant has demonstrated that the Plaintiff's service of the summons and complaint failed to comply with the requirements in Code of Civil Procedure Sections 416.10 and 415.20 for service of process on a corporate entity.  Therefore, Defendant is entitled under Code of Civil Procedure Section 473(d) to have the entry of default against the Defendant set aside.

If Plaintiff wishes to be heard on this tentative ruling, the Court will explain the basis of the ruling at the hearing today.
