The demurrer of Defendants of Ronald and Jerri Sternin, in their individual capacities and in their capacities as Trustees of the Sternin Trust, to Richard's First Amended Complaint is overruled. 

The demurrer of Defendants Richard Nickel, Joshua Konig, and Josh Konig, Inc. to Richard's First Amended Complaint is sustained with leave to amend and their motion to strike is granted with leave to amend as well.
