Defendants California Bank & Trust and Zion Bancorporation's (collectively 'the Banks') Motion for Summary Judgment is GRANTED as to Plaintiff Elyse Ver Hoeve's complaint. Plaintiff Hoeve has filed a notice of non-opposition to the motion. (ROA 70.) The Banks are not named in Defendant Scripps Reg, LLC and Regency Centers, L.P.'s cross-complaint and therefore the court cannot grant the Banks summary judgment as to the cross-complaint. While the court agrees, as a general matter, that amending the cross-complaint to name the Banks would be untimely and futile, that amendment or the request for leave to file such an amendment is not before the court at this time.
