Plaintiff Anthony Davide's unopposed Motion for Preliminary Approval of Class Action Settlement is GRANTED. At this stage the settlement terms are fair and in compliance with the requirements of Dunk v. Ford Motor Co. (1996) 48 Cal.App.4th 1794, 1800-1801. The court notes that this department's general policy is to limit fees in class action settlements at 33 1/3% of the gross settlement. The court recognizes that this policy may have exceptions in cases where counsel is able to substantiate fees that were actually incurred amounting to more than 33 1/3% exclusive of any contingency multiplier. For the purposes of preliminary approval alone, the court will grant the order stating that fees are not to exceed 35% and will review Plaintiff's fee request upon final approval.

The court is prepared to sign the order once the tentative is confirmed. The court will hear from the parties as to setting a Final Approval hearing date.
