Defendants Creekside Holdings, Ltd. and Wasatch Property Management's unopposed Motion to Compel Plaintiff Tammy McCollum's Response to Form Interrogatories, Special Interrogatories, and Request for Production of Documents is GRANTED. Sanctions are imposed in the reduced amount of $250.
On April 23, 2024, the parties, including Plaintiff, appeared in the court for an ex parte hearing. At that hearing the court 'inform[ed] plaintiff she is required to respond to defendant's discovery. The court further inform[ed] plaintiff if she does not respond to defendant's discovery her case may be dismissed.' Plaintiff then gave Defense counsel her updated address in open court so that discovery requests could be re-served. (ROA 63.) The court now orders Plaintiff to provide responses within 20 days. If no responses are provided within that time frame, the court invites Defendant to file a motion for terminating sanctions.
