REQUEST FOR COURT JUDGMENT AGAINST [DEFAULTING PARTY]:
| DAVID ASSOULINE |
RECOMMENDATION:
| DISMISSAL for failure to file a default package. |
TENTATIVE
On February 9, 2024, Plaintiffs’ counsel appeared at the OSC Re: Dismissal for failure to timely file default judgment package, in which the Court denied Plaintiffs’ request for default judgment filed on February 1, 2024.
At that time, the Court instructed Plaintiffs to submit a new default judgment package correcting the identified defects no later than February 16, 2024. Plaintiffs were on notice that failure to do so may result in the imposition of sanctions, including monetary sanctions and/or dismissal. (Min. Order, Feb 9, 2024.)
To date, Plaintiffs have failed to file a new default judgment package.
Accordingly, the Court orders the Complaint filed by Plaintiffs Yesenia Galindo and Jesus Cruz dismissed without prejudice.
