[TENTATIVE] ORDER DENYING PETITIONS TO CONFIRM MINOR’S COMPROMISE RE BOSTON JOHNSON AND KASH JOHNSON

Plaintiffs Leah Nealeigh, Taj Dasean Porch, Boston Johnson, and Kash Johnson (collectively
Plaintiffs”) filed a complaint against Defendants Hambone’s BBQ & Po Boys, Inc., Kenneth D. Hamilton, Andrea Hamilton, Daryl Jamaal Hamilton, and Ashraf Kamal Kamel Khalil for negligence, negligence per se, negligent entrustment of motor vehicle, wrongful death, and survival arising from a motor vehicle accident that occurred on or about June 16, 2018.  Plaintiffs allege Defendant Ashraf Kamal Kamel Khalil drove his vehicle onto the sidewalk where Plaintiff Leah Nealeigh was standing as a pedestrian, causing her great bodily injury and ultimately her death.  Petitioner Leon Johnson (“Petitioner”) moves for an order approving compromise of claim as to minor Claimants Boston Johnson and Kash Johnson (collectively “Claimants”).

 

The Court continued the hearing on petition to confirm minor’s compromise to May 15, 2023, because Petitioner did not file amended petitions for the Court to review.  (Minute Order of 04/11/2023 and 04/12/2023.)  The Court ordered Petitioner to submit amended petitions to the court by May 5, 2023.  (Id.)  Petitioner, however, failed to submit amended petitions by May 5, 2023.  As of May 10, 2023, no amended petitions were filed.

 

Accordingly, the petitions to confirm minor’s compromise are denied without prejudice.
