The Court excuses the personal appearance of Claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.¿ 

 

Plaintiffs have agreed to settle their claims against Defendants for the total amount of $5,000, with $1,000 being apportioned to minor claimant Leylanni Barron (“Leylanni”) and $1,000 to minor claimant Leah Barron (“Leah”) 

 

If the settlement is approved for Leylanni, $266.52 will be used for medical expenses, $250 for attorney’s fees, and $196 will be used for costs. The net balance of $287.48 will be delivered to her parent and guardian ad litem, Sergio Barron.

If the settlement is approved for Leah, $139.85 will be used for medical expenses, $250 for attorney’s fees, and $196 will be used for costs. The net balance of $414.15 will be delivered to her parent and guardian ad litem, Sergio Barron.  

 

The petitions filed on January 29, 2024 are denied for the following reasons: 

 

Both petitions have the same defects. No copy of the written attorney fee agreement was provided in Attachment 14a. Additionally, Attachment 18a (identify each party whom the attorney is representing in this matter) is absent.  

 

Lastly, Petitioner must file an Order Approving Compromise of Claim (MC-351) for each minor claimant.  

 

Petitioner must reserve a new date and file a new petition curing the above-noted defects at least 9 court days before the continued hearing date. 

 

Moving party is ordered to give notice.
