On December 17, 2019, Plaintiff Jeff Mejia Zaragoza (“Plaintiff”) filed this action against Defendant Carlos Valle-Paiz (“Defendant”) for damages arising from a motor vehicle collision. Trial is currently set for January 29, 2024.
On September 14, 2023, Plaintiff filed the instant joint motion requesting the Court to continue the Trial date and all related dates from September 18, 2023 to January 16, 2024, and the Final Status Conference (“FSC”) from September 18, 2023 to January 16, 2024. Both counsel for Plaintiff and Defendant filed declarations requesting the continuance and for all related motion and discovery deadlines to follow the continued trial date in order to complete discovery.
Since the filing of the motion, pursuant to oral stipulation at the FSC, the Trial date was continued to January 29, 2024 at 8:30 a.m., and the FSC continued to January 17, 2024 at 10:00 a.m. (Min. Order, Sept. 18, 2023.) However, the prior Order was silent as to whether the motion and discovery deadlines followed the new trial date. Per the joint request of the parties, all motion and discovery deadlines are to be based on the current trial date of January 29, 2024.
