[TENTATIVE] ORDER DENYING MOTION TO COMPEL DEPOSITION

Defendant TWS Facility Services, Inc. (“Defendant”) moves to compel Plaintiff Linda Cota (“Plaintiff”) to appear for her deposition and to pay monetary sanctions. Any opposition was due on or before February 14, 2024; none was filed.  

 

The trial date is currently set for March 13, 2024. CCP § 2024.020 provides any party shall be entitled as a matter of right to complete discovery proceedings on or before the 30th day, and to have motions concerning discovery heard on or before the 15th day, before the date initially set for the trial of the action. In other words, all discovery motions on this matter must be heard by no later than February 27, 2024. Defendant set the hearing for this motion on February 28, 2024. The motion is untimely, and therefore denied.  

 

Moving party is ordered to give notice.
