PLAINTIFF’S MOTION TO COMPEL FURTHER RESPONSES Dept. 31 1:30 p.m. May 9, 2023 |
Plaintiff Lymbhya Tavera Garcia (“Plaintiff”)
filed this action against Defendant Target Brands, Inc. (“Defendant”) for
injuries Plaintiff sustained when she slipped on a pool of liquid in
Defendant’s store and fell.
Plaintiff filed the instant motion
to compel further responses to requests for production of documents, set two,
against Defendant on April 12, 2023. Plaintiff
provides that she has scheduled an Informal Discovery Conference (“IDC”) for
May 8, 2023. The parties are ordered to
participate in the IDC as required by the Court’s Standing Order Re: PI Court
Procedures.
However, because the IDC is
scheduled only one court day before the hearing on this motion, the hearing on
the motion to compel further is continued to __________________ 1:30 p.m. in
Department 31 of the Spring Street Courthouse.
The Court is hopeful the hearing on
the motion to compel further will not be necessary. If the parties are unable to resolve all
outstanding issues at the IDC, the parties must submit a joint statement of
items in dispute at least five court days prior to the continued hearing
date. The joint statement must be a
single document, with analysis by both parties, addressing each remaining issue.
Plaintiff is ordered to give
notice.
