The motion is DENIED. 

Defendants Delmys Rivas and Gabriel Rivas (collectively, “Defendants”) move to compel responses to request for production of documents ("RPDs"), set one, against Plaintiff Raffi Roumdikian (“Plaintiff”).  Defendants assert that Plaintiff has failed to serve responses to the RPDs.  However, there is no proof of service of the motion attached to the moving papers showing proper service on Plaintiff. 

Because the Court cannot determine that proper notice of the motion and hearing was given the Plaintiff, the motion is denied.  The denial is without prejudice to Defendants refiling the motion after giving proper notice to Plaintiff.  The request for sanctions is denied.
