[TENTATIVE] ORDER DENYING WITHOUT PREJUDICE MOTION TO CONSOLIDATE

Plaintiff, Yesenia Andrade (“Plaintiff”) filed this action against Defendants, TRL Systems, Inc. (“TRL”), Tuan Quoc Nguyen (“Nguyen”), and TRL Systems-San Diego, LLC for damages arising out of an automobile incident on August 2, 2019.   

 

Defendants TRL and Nguyen now move for an order consolidating this action, 20STCV28679, with 21STCV27065, contending the two actions arise out of the same automobile accident The court has not received any opposition to the motion.  The two cases have been deemed related and are pending in Department 31; 20STCV28679 was designated the lead case.  (Min. Order, March 29, 2023.)   

 

The motion is denied without prejudice.  The motion does not comply with California Rules of Court, 3.350, which requires a copy of the notice of motion to be filed in each case sought to be consolidated.  (Cal. Rules of Court, rule 3.350(a)(1)(C).)  The Court’s records show that the notice of motion was not filed in 21STCV27065.  The denial is without prejudice to Defendants TRL and Nguyen refiling the motion after complying with all Rules of Court.  

 

Moving Defendants are ordered to give notice.
