DENY for reasons stated below. 

 

TENTATIVE 

 

Plaintiff Carmen Castaneda (“Plaintiff”) filed this action against defendants Joshua Oshiro (“Defendant”) and Does 1-25 for damages arising from a motor vehicle collision. Plaintiff has properly dismissed all unnamed Doe defendants. 

 

This is Plaintiff’s first request for court default judgment. The request submitted on March 29, 2024 is DENIED for the following reasons: 

 

First, Plaintiff did not complete the declaration of nonmilitary status on CIV-100, Item 8. This portion is unsigned. (CRC 3.1800(a)(5).) 

 

Second, for personal injury cases, Plaintiff must submit a copy of the Statement of Damages served on Defendant. (CRC 3.250(a)(20).) The Court is unable to locate a copy of the Statement of Damages purportedly served on Defendant on November 27, 2020. (Proof of Service, Dec. 11, 2020.) 

 

No later than ________, Plaintiff is to submit a new default judgment package correcting these defects.  Failure to do so may result in the imposition of sanctions, including monetary sanctions and/or dismissal. The OSC re entry of default judgment is continued to _________.
