1. Motion to Deem RFAs Admitted 

Defendant Heyman Western Avenue Properties, LLC (“Heyman”) propounded requests for admissions (“RFAs”), set one, on Plaintiff Ronaldo Carnicelli (“Plaintiff”) on May 16, 2023. (Mot. Decl. Dumitrescu 5; Exh. A.) Defendant Heyman declares that, as of the date of the filing of the motion,  Plaintiff had not provided responses or requested an extension. Defendant Heyman therefore seeks an order deeming the RFAs admitted. 

In opposition, Plaintiff contends that Plaintiff served substantive responses with verifications prior to the hearing, on June 21, 2023, one day after they were set to be due. (Opp. Decl. Behringer 7; Exh. 1.)  In light of the evidence that Plaintiff served verified responses to Defendant Heymans’ RFAs in substantial compliance with Cal. Code Civ. Proc §2033.220, the Court finds the motion moot.  (Cal. Code Civ. Proc §2033.280(c).)   

 

2. Sanctions 

Defendant Heyman does not request any monetary sanctions, and therefore none are awarded. Because Plaintiff served untimely responses, Plaintiff’s request for sanctions is denied.  

 

 Moving party is ordered to give notice.
