1. Motions to Compel
On December 28, 2022, Defendant Alicia Jane Henfrey (“Henfrey”) filed motions to compel Plaintiff Graciela Sandez (“Plaintiff”) to provide verified responses, without objections, to set one of form interrogatories, special interrogatories, and request for production of documents (“RPDs”). Plaintiff served verified responses to all of Defendant Henfrey’s propounded discovery on January 3, 2023. Therefore, the motions to compel are moot. Because the verified responses were served in advance of the hearing date, the request for monetary sanctions is denied.
2. Motions to Compel Further
On March 20, 2023, Defendant Henfrey filed motions to compel Plaintiff’s further responses to the same set of discovery: set one of form interrogatories, special interrogatories, and RPDs.
On June 15, 2023, counsels for Plaintiff and Defendant Henfrey appeared at the Informal Discovery Conference (“IDC”). The issues were deemed resolved. (Min. Order, June 15, 2023.) Pursuant to the discussion held at the IDC, counsels represented to the Court that a stipulation would be filed on counsels’ agreement. (Ibid.) To date, no such stipulation has been filed. However, given that no oppositions to the motions to compel further were filed, and based upon the representations made at the IDC, the Court finds these motions moot. The Court declines to award any monetary sanctions.
Moving Defendant is ordered to give notice.¿¿¿
