The motion to deem request for admissions, set two, admitted is moot in light of the responses served on Plaintiff prior to the hearing on this matter. (St. Mary v. Superior Court (2014) 223 Cal.App.4th 762, 776.).
Sanctions are sought and awarded against Defendant. Defendant is ordered to pay sanctions to Plaintiff, by and through counsel of record, in the amount of $660.00, within 20 days. The Court awards sanctions pursuant to Code of Civ. Proc. § 2033.280(c).)
Moving party is to give notice of ruling.
PLEASE TAKE NOTICE:
