[TENTATIVE] ORDER DENYING MOTION TO BE RELIEVED AS COUNSEL WITHOUT PREJUDICE
Dept. 31 1:30 p.m. April 10, 2024
|
Plaintiff Guadalupe Aispuro Robics (“Plaintiff”) attorney of record, Hali Aziz of Yagoubzadeh Law Firm, LLP (“Counsel”) moves to be relieved as counsel contending there has been an irreparable breakdown of the working relationship with Plaintiff.
The motion is denied without prejudice for the following reasons:
Counsel declares the moving papers were served on Plaintiff via mail at his last known address, which Counsel confirmed by “TLOxp.” The Court is unclear the method Counsel utilized to confirm Plaintiff’s address, and will require further explanation in a declaration regarding this “TLOxp.”
Further, there is no proof of service. Counsel has not filed proof of service of the notice of motion and motion, declaration, and proposed order on Plaintiff and on all other parties who have appeared in this action. (California Rules Court, rule 3.1362(d).)
Moving Counsel is ordered to give notice.
