[TENTATIVE] ORDER GRANTING IN PART MOTION TO BE RELIEVED AS COUNSEL

Plaintiff Lynn Deanne McNatt James (“Plaintiff”) attorneys of record, Bish and Cutting, APC (“Counsel”) and Law Offices of Larry H. Parker (“Associated Counsel”) move to be relieved as counsel, contending that the attorney-client relationship has been undermined by differences between Counsel and Plaintiff, and Counsel is unable to represent Plaintiff as a result of the deterioration of the attorney-client relationship.    

Counsel declares it served the moving papers at the Plaintiffs last known address.  Counsel declares the moving papers were served on Plaintiff via mail and e-mail at an address that Counsel confirmed as current by telephone within the past 30 days. Counsel has filed proof of service on Plaintiff and on Defendant Randy Estuardo Alvarado Alvarez. No other defendants have appeared in this action.   

However, the Court notes that Associated Counsel failed to sign the moving papers. Associated Counsel must file and properly serve their own separate request to be relieved as counsel.  

The motion is unopposed and granted as to Bish and Cutting, APC only; the ruling is effective upon filing proof of service of the final order.  The Court notes that a Notice of Settlement was filed on October 17, 2022. An Order to Show Cause Re: Dismissal is scheduled for July 25, 2023.  

 

Moving Counsel is ordered to give notice.
