The Court excuses the personal appearance of Claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.
Plaintiffs have agreed to settle their claims for the policy limits of $100,000, with $50,000 being apportioned to Kristian N. Russell (“Claimant”). If the settlement is approved, $2,348.16 will be used for medical expenses, $16,666.67 for attorneys’ fees, and $739.47 will be used for costs. The net balance of $30,245.70 will be invested in a single-premium deferred annuity, subject to withdrawal only on authorization of the court.
The Court has reviewed the settlement and finds it fair and reasonable. The Court also finds the attorneys’ fees fair and reasonable, in that Claimant’s counsel provides a satisfactory declaration in support of 33.33% of Claimant’s settlement.
