The Court excuses the personal appearance of Claimants and the guardian ad litem. Counsel may appear by telephone or video conference call.¿¿
The Court has reviewed the Petition to Approve Compromise of Pending Action of a Minor Esmerelda Shaheen-Ponce (“Esmerelda”), Age 14, and Nyah Shaheen-Ponce (“Nyah”), Age 11.
Defendants settled for $37,000, with the settlement amount apportioned as follows: $33,500 to Petitioner/Plaintiff Gloria Ponce, $2,500 to Esmeralda, and $1,000 to Nyah.
Pertaining to Esmeralda, if the settlement is approved, $625 will be used for attorney’s fees, and $242.50 for expenses, and $457.30 for medical expenses. The net balance of $1,175.20 deposited into a blocked account.
Pertaining to Nyah, if the settlement is approved, $250 will be used for attorney’s fees, and $242.50 for expenses. Nyah incurred no medical expenses. The net balance of $507.50 will be deposited into a blocked account.
The Court has reviewed the settlement and finds it fair and reasonable. The Court also finds the attorney’s fees fair and reasonable in that they amount to 25% of the minors’ settlement.
Based thereon, the Court approves and GRANTS the petition.
