Plaintiff Tasha Marcella Clark’s (“Plaintiff”) attorney of record, Andrew L. Ellis, Esq. (“Counsel”), moves to be relieved as counsel for Plaintiff. Counsel contends relief is necessary because Plaintiff has been non-compliant with Counsel’s employment agreement. Counsel provides it has served the moving papers on Plaintiff at Plaintiff’s last known address. However, Counsel does not indicate if/how Counsel confirmed Plaintiff’s address as current in the past 30 days, nor does Counsel indicate whether Counsel was unable to confirm Plaintiff’s address is current.
Therefore, the motion is denied without prejudice. If Counsel is unable to serve Plaintiff at a confirmed address, Counsel must serve the moving papers on the Clerk of the Court- located at Stanley Mosk Courthouse- pursuant to CCP §1011 and California Rules Court, rule 3.1362(d).
Moving Counsel is ordered to give notice.
