The Court excuses the personal appearance of Claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.¿¿
The Court has reviewed the Petition to Approve Compromise of Pending Action of a Minor Abigail Bostadjian (“Claimant”), Age 9, filed on January 26, 2024.
This matter settled with cross-defendant Hamazasb Aghajaniani for the policy limits of $100,000 and with defendants Tanner and Alan Haynes for the policy limits of $250,000, for the total sum of $350,000. If the settlement is approved, $1,284.06 will be used for medical expenses, $8,838.07 will be used for expenses other than medical, and $87,500 for attorney’s fees. The net balance of $252,377.87 will be invested in a single-premium deferred annuity.
The Court reviews the settlement and finds it fair and reasonable.¿The Court also finds the attorney’s fees fair and reasonable, in that it amounts to 25% of Claimant’s settlement. Based on the foregoing, the petition is GRANTED.
