[TENTATIVE] ORDER GRANTING MOTION TO BE RELIEVED AS COUNSEL

Plaintiff Johnny Angele Guzman (“Plaintiff”) attorney of record, Adina A. Ostoia and KJ Injury & Accident Lawyers, PC (“Counsel”), move to be relieved as counsel for Plaintiff. Counsel contends relief is necessary because of a breakdown in attorney-client communication such that continued representation is no longer feasible. Counsel avers that they have been unable to reach Plaintiff to sign a consent pursuant to CCP section 284(1).
Counsel provides that the moving papers were served on Plaintiff at Plaintiff’s last known address, which was confirmed by a background check. Counsel has filed proof of service of the motion, declaration, and proposed order were on Plaintiff. (Cal. Rules of Court, rule 3.1362(d).)
The motion is unopposed and GRANTED; the ruling is effective upon filing proof of service of the final order. No trial date has been set. Therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare prior to trial.
Moving Counsel is ordered to give notice.
