Defendant Los Angeles County Metropolitan Transportation Authority (LACMTA) requests the Court to take judicial notice of (1) Felony Abstract of Judgment filed 9-7-22, Peo. v Santino Anthony Mitchell, et al., Case No. BA489749, (2) Reporter’s Transcript, Plea and Sentence hearing filed 10-5-22, Peo. v Santino Anthony Mitchell, et al., Case No. BA489749, (3) Felony Sentencing Memorandum dated 8-11-22, Peo. v Santino Anthony Mitchell, et al., Case No. BA489749, and (4) Amended Felony Complaint filed 5-26-22, Peo. v Santino Anthony Mitchell, et al., Case No. BA489749. 

 

Defendants Jonathan Antonio Mitchell and Santino Anthony Mitchell oppose the request, and LACMTA filed a reply. 

 

Without the Court even determining whether the documents are in fact judicially noticeable, “There is, however, a precondition to the taking of judicial notice in either its mandatory or permissive form—any matter to be judicially noticed must be relevant to a material issue.”  (People ex rel. Lockyer v. Shamrock Foods Co. (2000) 24 Cal.4th 415, 422 fn. 2.) This standalone request for judicial notice, unrelated to any particular motion to determine a material issue, is therefore DENIED 

 

Moving party is ordered to give notice.
