TENTATIVE 

The request for default judgment submitted on April 24, 2023 is GRANTED for the following reasons: 

Previously, the Court denied, without prejudice, Plaintiff’s request for default judgment and ordered Plaintiff to submit an amended single judgment on form JUD-100 against Defendants. Additionally, the Court provided that the proposed judgment must include a notation limiting the owner’s liability, and identifying the owner, to no more than permissible per Code. Plaintiff may recover the remainder of the judgment sought against the driver only, which likewise should be identified on the proposed judgment to avoid any confusion. (Min. Order, April 6, 2023.) The Court finds Plaintiff has complied with the order.  

According, to the summary of case, Plaintiff seeks two separate judgments: (1) $35,491.32 against Ingrid Ramos aka Ingrid Farela, the driver; and (2) $20,000.00 against Rosa Castaneda aka Rosa Ramos, the owner of the vehicle, jointly and severally. 

Plaintiff submits a declaration sufficient for the Court to award $55,491.32 in damages for subrogation arising out of the property damage and medical expenses. Plaintiff’s memorandum of costs as part of the request for entry of court judgment requests $541.15 in costs. This amount is recoverable. 

The applications for default judgment filed on April 24, 2023 is GRANTED in the total amount of $20,000.00 against Rosa Castaneda aka Rosa Ramos and $35,491.32 against Ingrid Ramos aka Ingrid Farela.  

Plaintiff is ordered to give notice of this ruling.
