[TENTATIVE] ORDER GRANTING MOTION TO BE RELIEVED AS COUNSEL

Paul Park, attorney of record (“Counsel”) for Plaintiffs William Dailey and Javonte Thomas (collectively, “Plaintiffs”), seeks to be relieved as counsel on the grounds that Counsel has lost contact with each of the Plaintiffs. Counsel declares he has been unable to confirm whether the Plaintiffs’ last known address is their current address. Counsel further declares having attempted to call the Plaintiffs at their last known phone numbers, and that prior letters to the Plaintiffs were returned to Counsel’s office. Counsel also has filed proofs of service indicating that the moving papers were mailed to the Plaintiffs at their last known address and that copies of the same were also served on the Clerk of the Superior Court per Code of Civil Procedure section 1011(b)(3) and per the Court’s May 27, 2022 minute order.

The motion is unopposed and granted. The Court does note, however, that the proposed orders (Form MC-053) filed on April 14, 2023 contain an outdated trial date and Final Status Conference date that were continued on April 28, 2023 per stipulation of the parties. Accordingly, this ruling will be effective upon Counsel’s filing of both an updated proposed order (Form MC-053) for each of the Plaintiffs, reflecting the current trial date, FSC date, and all other future hearing dates, plus a proof of service of the final order. The Court notes trial is not scheduled until December 12, 2023. Therefore, there will be no prejudice as a result of the granting of this motion.  

 

Counsel is ordered to give notice.
