Defendant Penske Truck Leasing Co., L.P.’s motion for summary judgment was set for hearing on April 10, 2024.   

 

However, on November 30, 2023, Plaintiff filed a Request for Dismissal dismissing Penske Truck Leasing Co., L.P. from the action without prejudice; the dismissal was entered on November 30, 2023.   

 

The motion for summary judgment directed at Plaintiff’s Complaint is therefore moot and will be taken off-calendar. The Court asks counsel to promptly take matters off-calendar when they become moot. 

 

Moving party is ordered to give notice.
