The Court excuses the personal appearance of Claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.¿
Plaintiffs have agreed to settle their claims against Defendants, with $24,999.99 being apportioned to BB (“Claimant”). Pursuant to the Order from Dept. 30, the request for attorney’s fees was reduced from 40% of Claimant’s settlement proceeds to 25%, and the following distribution was approved:
Out of Claimant’s settlement, $6,250 is to be used for attorney’s fees, $19.64 to be used for medical expenses, and $1,154.48 to be used for costs, with the net balance of $17,575.87 to be invested into an annuity. (Min. Order, Dec. 1, 2023.) Petitioner was ordered to file a new proposed order in accordance with the Court’s distribution. (Ibid.)
On December 11, 2023, Petitioner filed a new proposed order in accordance with the adjusted distribution. Therefore, the Court finds the settlement fair and reasonable, and based on the foregoing, the petition is GRANTED.
Moving party is ordered to give notice.
