[TENTATIVE] ORDER DENYING AS MOOT DEFENDANT’S MOTION TO COMPEL FURTHER

Plaintiff, Daniel Abram (“Plaintiff”) moved to compel further responses to form interrogatories, set one and special interrogatories, set one, on December 13, 2022, on Defendant Soulcycle Beverly Hills, LLC (“Defendant”).  The parties participated in an Informal Discovery Conference (“IDC”) on March 13, 2023.   At the conclusion of the IDC, the court ordered Defendant to provide further responses to requests nos. 1 through 8 on Plaintiff’s IDC statement in 30 days.  (Min. Order March 13, 2023.) 

 

On June 7, 2023, Defendant opposed Plaintiff’s motion, arguing that it is moot because Defendant served the responses on April 12, 2023, and verified the responses on April 14, 2023. (Decl. Lee-Gulley ¶¶ 4-5, Exs. B and C.)

 

To date, Plaintiff has not taken the motion off calendar, as was requested by the Court after resolution of the discovery issues at the IDC. As the discovery issues were resolved at the IDC, this motion is denied as moot.  

 

Moving Plaintiff is ordered to give notice. 

 

Parties who intend to submit on this tentative must send an email to the court at sscdept31@lacourt.org indicating intention to submit on the tentative as directed by the instructions provided on the court website at www.lacourt.orgIf the department does not receive an email indicating the parties are submitting on the tentative and there are no appearances at the hearing, the motion may be placed off calendar.  If a party submits on the tentative, the party’s email must include the case number and must identify the party submitting on the tentative.  If the parties do not submit on the tentative, they should arrange to appear remotely.
