TENTATIVE
Plaintiff seeks reimbursement for the amount it paid for its insured’s damages in the principal amount of $29,837.43 in this subrogation claim. Plaintiff also seeks costs in the amount of $772.26 and pre-judgment interest in the amount of $1,826.23. Plaintiff has properly dismissed all other parties in this action aside from Defendant Fahad Alraqwah aka Fahad Ahmad Saood Al Raqwah.
Plaintiff seeks damages in the principal sum of $29,837.43, in accordance with amount sought in the Complaint. Plaintiff, through its custodian of records and subrogation manager, substantiates the principal amount by providing proof of property damage costs and payment rendered to the insured for the bodily injury claim.
Plaintiff submits the declaration of its attorney regarding pre-judgment interest at 7% interest, within the limits of Cal. Const. Art XV, 1 and CC §3287(c), and provides the interest calculation.
Plaintiff further seeks costs of $772.26, comprised of clerk filing fees and process server’s fees, which are allowable under CCP §1033.5.
The application for default judgment filed on July 10, 2023 is GRANTED in the total amount of $32,435.92 against Defendant Fahad Alraqwah aka Fahad Ahmad Saood Al Raqwah.
Plaintiff is ordered to give notice of this ruling.
