[TENTATIVE] ORDER GRANTING MOTION TO BE RELIEVED AS COUNSEL

Plaintiff Scott Newberger (“Plaintiff”) attorney of record, Douglas Younglove, Esq. of the Law Offices of Jacob Emrani (“Counsel”), moves to be relieved as counsel contending relief is necessary because the attorney-client relationship has had a complete breakdown. The breakdown in the attorney-client relationship has resulted in Plaintiff suing his own attorneys.
Counsel has attached a proof of service demonstrating service of the motion, declaration, and proposed order on Plaintiff by both mail and by electronic mail. (Cal. Rules of Court, rule 3.1362(d).)
Counsel declares he was unable to confirm Plaintiff’s current address after calling Plaintiff’s last known number. Counsel also emailed Plaintiff and received a reply, wherein Plaintiff refused to confirm his address. Counsel provides a declaration that the electronic service address is current, in compliance with California Rules of Court, Rule 3.1362(d)(2).
The motion is unopposed and granted; the ruling is effective upon filing proof of service of the final order. No trial date has been set for this matter. Therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare prior to trial.
Moving Counsel is ordered to give notice.
